NMTORC Club Constitution


Article I - NAME

The official name for this club will be the New Mexico Tech Off-Road Club, abbreviated NMTORC. The responsibilities of the members and elected officials of the club shall be outlined by the following articles.

Article II - PURPOSE

The primary purpose of the New Mexico Tech Off-Road Club is to involve members in various styles of off-road events. The members are to attend regional events when possible, and participate when they feel so inclined.

Article III - MEMBERSHIP

Membership in the New Mexico Tech Off-Road Club is open to all members of the New Mexico Tech community. The New Mexico Tech community includes:
  • New Mexico Tech full-time or part-time students
  • New Mexico Tech full-time or part-time employees
The ability to participate in events will be based on the rules in place by the governing bodies. No member will be turned away because of the inability to attend or join in any event.

Article IV - MEETINGS

The New Mexico Tech Off-Road Club will be required to hold at least two meetings per month. Meeting times and places are to be prearranged by the president of the club. The meetings shall be held at a convenient time for as many of the members as possible.

Article V - EXECUTIVE BOARD

The New Mexico Tech Off-Road Club will have:
  1. A President, whose duties include:
    • Preside at all meetings
    • Generate a calendar of events for the semester
    • Organize trips to special events
    • Inform members of events
    • Bring to vote any matter brought before the club
    • Purchasing and Maintenance of the Club Budget
    • Be responsible for the cleanliness of the maintenance shop after every work session
  2. A Vice President, whose duties include:
    • Assist President as he or she sees fit
    • Preside at all meetings
    • Help organize trips to special events
    • Inform members of events
    • Bring to vote any matter brought before the club
    • Be responsible for the cleanliness of the maintenance shop after every work session
Additional elected positions may be part of the New Mexico Tech Off-Road Club. The above list represents the minimum elected positions the New Mexico Tech Off-Road Club can function with.

Article VI - ELECTIONS

Officers shall be elected at the beginning of every semester by current members of the New Mexico Tech Off-Road Club who have paid any dues or fees required by the day of election. Elections shall be held during the first meeting of each semester. The fall term shall be from the first week of school in August until the first week of school in January. The spring term shall be from the first week of January until the end of finals week in May. The summer term shall be from finals week in the spring until the first week of school in the fall.

Article VII - FINANCES

Section 1. Budget

The New Mexico Tech Off-Road Club will be expected to develop a budget request in the format required by NMT Student Government Association. In addition, the New Mexico Tech Off-Road Club must realize that clubs have the responsibility to generate funds to augment any funding given by the Student Government Association. Student fees are not expected to fund 100% of the clubs activities.
No money from the club is to ever to be spent on any individual's vehicle. This includes, but is not limited to: factory or after-market parts and accessories, raw materials, gasoline, and periodic maintenance or repairs.

Section 2. Inventory

The New Mexico Tech Off-Road Club will be expected to maintain an adequate, itemized inventory of all items purchased with money granted by the Student Government Association. This inventory is to be maintained by the president of the club. All tools should be engraved with the club name to help prevent loss of property.

Section 3. Sponsorship

The members of the club shall seek outside sponsorship to obtain funds necessary to attend or host events pertaining to the New Mexico Tech Off-Road Club. Sponsorship may be in the form of either funds or needed equipment for the club.

Section 4. Fund Raising

The club may hold special events in order to acquire funds. Any event which requires special insurance or licensing shall be done so in the manner that is required by the law or that of the sanctioning body.

Article VIII - AFFILIATIONS

The New Mexico Tech Off-Road Club will become involved with any governing bodies that the club officials feel necessary in order to function properly. Individual involvement of the members will be recommended on a case-by-case scenario.

Article IX - ADVISER

The New Mexico Tech Off-Road Club will select a full-time faculty/staff member to serve as the club adviser. The adviser should have an interest in off-roading as well as a desire to help the club prosper. The duties of the club adviser shall include:
  • The overseeing of meetings and club decisions
  • To apply the guidelines outlined in the constitution
  • To help assure the safety of the members in events

Article X - RATIFICATION

The New Mexico Tech Off-Road Club will vote on and amend all of the articles of the constitution before it is ratified.

Article XI - IMPEACHMENT AND EXPULSION

Section 1: Officers

Should the members of the club feel that any member of the executive board be unable to see to his/her duties, an impeachment hearing can be held and with a 2/3 majority, the said member will be removed from office. Following the removal of an officer, an emergency election is to be held so that no required position will be left vacant.

Section 2: Members

Should a member of the executive board feel that a member is acting dangerously, recklessly, or without regard to others' safety, the member can be removed with a 2/3 majority vote among the executive board. Should a 2/3 majority vote be reached, the member will be permanently expelled from the club.

Section 3: Member Expulsion Repeal

Should the member feel that their expulsion is unfair, the member can ask for an appeal. The club officers are to bring this matter to the club members, and should a 2/3 majority vote be cast, the member's expulsion shall be reversed.

Section 4: Shop Privileges

Both the President and the Vice President are responsible for the cleanliness of the shop. They are to enforce the shop rules and cleanliness standards to the members. Should the executive board find that a member has no regard for the rules or cleanliness standards, they can revoke shop privileges on a per-person basis as they see fit.

Article XII - AMENDMENTS

Amendments to this constitution will be brought forward to the president of the New Mexico Tech Off-Road Club. The amendment shall be voted on and, with a 2/3-majority vote, the amendment shall be ratified.

Article XIII - TOOLS

Section 1: Loaning of Tools

The club president is responsible for the whereabouts of all tools owned by the club. The president is to keep a log whenever a tool is loaned out to a member. The log should contain the date of the loan, the name of the specific tool, and initials upon both checkout and return of each tool on loan. The tools are not to be loaned out for a period exceeding seven days. The member must return the tool immediately at the request of the president, in order to loan it out to someone else.

Section 2: Condition of Tools

All tools are to be kept in good condition. Should a tool be broken, the member wielding that tool shall be held responsible. The member is to replace the tool with an identical tool as soon as possible, and they are allowed to keep the broken one. There is an exception of tools that are covered under warranty. It is the duty of the president or vice president to exchange these tools under warranty at their earliest convenience.

Article XIV - EVENT LIABILITY

In consideration of participation in any event sponsored, promoted or directed by New Mexico Tech Off-Road Club, the members for himself, his personal representative, heirs, and next of kin hereby releases NMTORC, its officers, directors, promoters, sponsors, employees and agents, as well as the owners of the property upon which the event is held, of all liability, whether caused by the negligent act, or omission of NMTORC or otherwise while for any purpose participating in such an event. The participant acknowledges that there is inherent risk associated with this event, including damage to vehicles, and fully assumes the risks involved.

In addition, the members agree to indemnify, and hold harmless NMTORC from any loss, liability damage, or cost he or she incurs due to such participation by the member, whether caused by NMTORC's negligence or otherwise and agrees to full responsibility and risk for any bodily injury, death, or property damage from NMTORC's negligence or otherwise while the member is participating in this event.
